3 03-07-2023 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence, on the order of petitioner no. 2, petitioner no. 1 gave Farsa blow on the head of husband of informant. Petitioner no. 5 gave lathi blow on the chest of informant and

snatched cash of Rs. 10,000/- from his pocket. Petitioner no. 3 assaulted the grandson of informant due to which his hand got fractured.

It is submitted that due to quarrel between the children the alleged occurrence took place in which both sides sustained injuries. There is case and counter case. The doctor has found the injury sustained by the injured simple in nature. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Rajepur P.S. Case No. 119 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
