Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends arrest in connection with Fatuha P.S. Case No. 42 of 2022 registered for the offences under Sections 419, 420, 379, 341, 323, 504, 506 and 34 of the Indian Penal Code and later on added Section 386, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that similarly situated co-accused persons have already been granted anticipatory bails by a co-ordinate Bench of this Court vide orders dated 13.12.2022 and 19.12.2022 passed in Cr. Misc. Nos. 48827 of 2022 and 51831 of 2022 respectively. Further he submits that petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., Patna City, Patna in connection with Fatuha P.S. Case No. 42 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
