Heard learned senior counsel for the petitioner and

learned Central Government Counsel for the N.C.B.

This is the second attempt of the petitioner to seek

bail as earlier, the bail application of the petitioner was rejected by order dated 21.04.2022 in Cr. Misc. No.68431 of 2021.

Though the merit of the case was considered when

the bail was rejected, but on insistence of the learned senior counsel, the Court still does not feel persuaded to grant bail to the petitioner based on the submission made by the learned Central Government Counsel that 1031.300 kg. of

Ganja was recovered from a truck and driver Giriwardhary Pandey and Rajendra Ram were arrested and while the N.C.B. Officials were interrogating them, when they received a call from mobile no.9142864568 and when N.C.B. asked about the caller, it was disclosed that the call was made by Rakesh Kumar and this petitioner and there whereabouts was also provided by the driver. In pursuance whereof, the N.C.B. officials reached the place of occurrence and arrested Rakesh Kumar along with this petitioner.

This amply demonstrates that this petitioner was in league and connivance with the driver of the truck from which huge quantity of ganja was recovered. It is true that nothing was recovered from possession of the petitioner, nor he was arrested at the place of occurrence, nor subsequently in raid from his house, anything was recovered, but what is admitted and is not disputed is that petitioner based on information provided by the driver of the truck was apprehended by the N.C.B. from the place of occurrence, which directly connects the petitioner with the offence.

C.G.C., the Court is not inclined to release the petitioner on
