Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Dawath P.S. Case No. 53 of 2016 registered for the offences punishable under Sections 341, 323, 354, 379, 384, 448, 504, 506, 376, 511/34 the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, petitioner along with co-accused Sanjay Choudhary entered the house of the informant and abused and assaulted the wife of the informant and snatched her

Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. Allegation against the petitioner is that he along with Sanjay Choudhary entered the house of the informant and abused and assaulted the wife of informant. FIR was lodged under section 376 and other minor sections of the IPC but after investigation the police has submitted charge sheet against co-accused Sanjay Choudhary under sections 354B, 379, 384, 448, 504, 506/34 of the I.P.C. learned counsel for the petitioner submits that earlier, the niece of the petitioner has filed a case against son of the informant under section 376 and other minor sections of the I.P.C. It is further submitted that petitioner has clean antecedent as stated in para-3 of this application.

Considering this fact that the police has filed charge sheet against the co-accused under section 354B of the I.P.C, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Rohtas at Sasaram in Dawath P.S.
