Heard Mr. Subodh Kumar, learned counsel appearing

on behalf of the petitioner and Mr. Ajay Kumar No. 2, learned APP appearing on behalf of State.

The petitioner apprehends his arrest in connection with Mahua P.S. Case No. 734 of 2021 registered under Section 414 of the Indian Penal Code and Sections 30(a), 32(ii), 38(ii) and 41(i) of Bihar Prohibition and Excise Amendment Act, 2018.

Taking into consideration the fact that large quantity of liquor has been recovered from the truck bearing Registration No. RJ-14GL-8047, Pickup Van bearing registration no. BR01GD-0252 and Motorcycle bearing registration no. BR31B-2927, the Court below is directed to seek report with respect to aforementioned vehicles from the District Transport Officer, Vaishali, in case the report reveals that the vehicles are not stolen one and the

petitioner is not the owner of the aforesaid vehicles, then the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court cum ADJ-II, Vaishali in connection with Mahua P.S. Case No. 734 of 2021, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
