ORAL ORDER
2 23-06-2022 Heard learned Counsel for the petitioner.
The present application has been filed on behalf of the petitioner-defendant for a direction to the learned Court below to dispose Title Suit No. 46 of 2018 as early as possible without giving any unnecessary adjournment to either parties.
Learned Counsel for the petitioner submits that the petitioner is a retired Professor, aged about 67 years and has purchased the suit land in the year 1978 and has also constructed a residential house over the suit land. He further submits that the petitioner, who is the main contesting defendant in the suit, has already entered his appearance and has also filed written statement. He further submits that issues have already been framed in the suit and the suit is fixed for evidence.
Regards being had to the aforesaid fact, the learned Court below (Sub Judge-I, Barh, Patna) is requested to expedite the disposal of Title Suit No. 46 of 2018 in accordance with law without giving unnecessary adjournment to either parties.
