2 11-02-2022 Petitioner has prayed for following relief (s) : -
(i) For quashing/setting aside the Letter bearing Ref: MDO/R/Kaushalya Nath dated 16.12.2021 whereby "B" site retail outlet, M/s Kaushalya Nath Services, a dealer of Indian Oil Corporation Ltd., Benipatti, District Madhubani has been terminated without following the principles of natural justice as well as without considering the factual matrix of the case and also quashing/setting aside the Letter for suspension bearing Ref MDO/R/Kaushalya Nath/217202/01 dated 13.12.2021 whereby the sales and supply from the retail outlet of M/s Kaushalya Nath Services, a dealer of Indian Oil Corporation Ltd. at Benipatti, District Madhubani has been suspended in utter violation of the natural justice and without looking into the facts of the present case.
(i) For the issuance of writ in the nature of mandamus directing the Respondents to reinstate the dealership of the Indian Oil Corporation Ltd. to the petitioner and consequent thereupon to start the sales and supply from the retail outlet of M/S Kaushalya Nath Services, a dealer of Indian Oil Corporation Ltd. at Benipatti, District Madhubani.
(iii) For the issuance of any other appropriate writ/(s)/order/(s)/direction/(s) for which the petitioner is found entitled for in the present facts and circumstances of the case by this Hon’ble Court.”
Learned counsel for the petitioner, under
instructions, fairly states that the petition, in its present form, may be permitted to be withdrawn reserving liberty to file afresh
