The petitioners apprehend their arrest in connection with Balia P.S. Case No.214 of 2021, registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

The petitioners are said to have kidnapped the minor daughter of the informant.

Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. Petitioner No.1 is the mother of co-accused Guddu Kumar and the specific allegation is against Guddu Kumar. Petitioners

No.2 and 3 are the daughter and son of petitioner no.1. There is no specific allegation against these petitioners. It is further submitted that the victim girl has been recovered and her statement was recorded under Section 164 Cr.P.C. in which she has not taken the names of these petitioners.

The learned APP for the State and the learned counsel for the informant opposed the prayer for anticipatory bail of the petitioners.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Balia P.S. Case No.214 of 2021, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
