(petitioner no. 7) having been scheduled for 13.05.2022 and the other petitioners being near relatives of aforesaid Kajal Kumari, this petition has been given a priority hearing.

Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Sugauli P.S. Case No. 292 of 2021, G.R. Case No. 4002 of 2021 instituted for the offences under Sections 143, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

According to the accusation in the F.I.R, all the accused persons have participated in the assault as a result of which, two persons, namely, Rajesh Jha and Ranjan Jha have received injuries. However, both the injuries are reported to be simple in nature.

The learned counsel for the petitioners has submitted that the accusation is false and overtly exaggerated. Because of enmity between the parties, the aforesaid case has been lodged in which all persons of a family have been made accused.

There is a counter version of the occurrence also which has been lodged by petitioner no. 6 vide Sugauli P.S. Case. No. 291 of 2021. In that case many persons from the side

of the petitioners also have received injuries.

Regard being had to the afore-stated facts and taking into account that in the earlier cases lodged against petitioner nos. 5, 6, 7 and 8, they have been granted bail, all the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Sugauli P.S. Case No. 292 of 2021, G.R. Case No. 4002 of 2021, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure
