Heard the learned counsel for the petitioner and the
learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Laxmipur P.S. Case No. 131 of 2021 for the offence registered under Sections 395, 397 and 412 of the Indian Penal Code.
The allegation is regarding six unknown miscreants, whose faces were covered, having intercepted the informant and his companion and thereafter they are alleged to have committed loot and snatched a motorcycle, a laptop, two mobile phones, cash amounting to a sum of Rs. 70,600/- and gold ornaments etc.
The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case and he is languishing in custody since 11.08.2021.

The learned counsel for the petitioner has further submitted that since no Test Identification Parade has been held, therefore, benefit should be granted to be petitioner for the purposes of grant of bail.
Per contra, the learned A.P.P. for the State has referred to the impugned order dated 08.10.2021 passed by the learned Sessions Judge, Jamui to submit that during the course of investigation, one suspect namely Ayush Kumar was arrested and he is stated to have disclosed the name of his accomplices including that of the petitioner herein. It is also submitted that the petitioner is having a bad antecedent inasmuch as he is accused in three other cases.
I have heard the learned counsel for the parties and perused the materials on record from which it is apparent that the petitioner is a habitual offender and sufficient materials are on record to prima facie show the complicity of the petitioner in the alleged crime, hence I do not find any merit in the present petition, thus the same stands dismissed.
