The petitioners apprehend their arrest in Rupaspur P.S. Case No. 313 of 2020, registered for the offences punishable under Sections 379, 323 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that petitioners along with co-accused persons abused the informant in filthy language and on protest petitioner no. 2 assaulted the informant on her breast and torn her blouse and petitioner. 1 snatched ‘Jitiya’ from her neck and roughed her hand in drunken condition.

It is submitted that petitioners have been falsely implicated in this case. There is case and counter case. There is general and omnibus allegation and no specific allegation of assault is against petitioners. As a matter of fact, land dispute between the parties were going on, as a result of which scuffle took place in which both sides sustained injury.

Considering the facts aforesaid and the fact that dispute is purely civil in nature, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Danapur, Patna in connection with Rupaspur P.S. Case No. 313 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
