2 28-11-2022 Heard Mr. Shrinandan Prasad Singh, learned Senior Counsel for the petitioner duly assisted by Mr. Kumar Sameer, Advocate and Mr. Jitendra Kumar Singh, learned APP for the State.

The case is registered under Sections 341, 420, 406, 120B, 387, 323, 506, 504 and 34 of the Indian Penal Code in connection with Kurhani P.S. Case No. 479/2021.

This case was earlier heard and rejected on 24.5.2022 vide Cr. Misc. No. 70376 of 2021.

Mr. Shrinandan Prasad Singh, learned Senior Counsel has brought on record the affidavit vide Annexure-3

by which the informant has given a notary affidavit stating therein that he has been paid a sum of Rs. 3,00,000/- and as such he has no objection if bail is granted to the petitioner.

Taking into account the fact that he has been in custody since 6.9.2021, charge-sheet already stands submitted, there is an affidavit of the informant (Annexure-3), this Court is inclined to grant him the privilege of bail with conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of A.C.J.M.1st, Muzaffarpur, in connection with Kurhani P.S. Case No. 479/2021 with the following conditions :

(i) one of the bailor should be the family member of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial Court itself;

(iii) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at

liberty to take steps for cancellation of his bail bonds.

With the aforesaid observations, the bail application

is allowed.
