3 18-04-2022 Heard learned counsel for the parties.

A Kochas (Parasthua) P.S. Case No. 32 of 2012 was lodged on 10.04.2012 registered under Sections 302, 307 and 324/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner herein was the named accused in the FIR. However, from the date of registration of the FIR, he evaded arrest and chose not to appear.

It was only in the year 2022, i.e. 30.10.2020 that he finally came into judicial custody. A bare perusal of the learned Session’s Judge order shows that although charge-sheet was filed against the petitioner under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, he never appeared before the Court since the institution of the case and the chargesheet was filed showing him an absconder. observed that if given a chance, the petitioner will flee again while the trial of the co-accused (Trial No. 359 of 2021) has already been concluded.

Taking into account the aforesaid facts, this Court is not convinced to give any relief to the petitioner. He shall face trial, cooperate in it and take the same to its logical conclusion. The Trial Court is directed to take all steps to conclude the trial at an earliest.

With the aforesaid observations, the bail application is

rejected.
