The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned APP Sri Akhileshwar Dayal for the State.

Petitioner seeks bail in connection with Chiraiya (Shikarganj) P.S. Case no. 140 of 2021 registered for the offence punishable under sections 394, 307 of the Indian Penal Code read with sections 25(i-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 6.6.2021, is person with clean antecedent and charge sheet has been submitted. Allegation is

recovery of one county made pistol with magazine and one empty cartridge from his possession. Learned counsel further submits that petitioner has been falsely implicated in this case as nothing was recovered from his possession.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody, is person with clean antecedent and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in Chiraiya (Shikarganj) P.S. Case no. 140 of 2021.
