Heard learned counsel for the parties.

The petitioner seeks bail in a case registered for the

offence under Section 395 of the Indian Penal Code.

As per the prosecution case, while the informant was

on way to his shop on scooty, two miscreants riding on a motorcycle intercepted him and thereafter, three more miscreants came, having pistol in their hands fired upon the informant, as a result of which, he received fire-arm injuries and thereafter, they looted away cash and ornaments from him.

Name of the petitioner transpired during course of investigation. It is submitted on behalf of petitioner that the articles recovered from the possession of this petitioner were house-hold articles and till date, same were not put on T.I.Parade or identified by the informant. In paragraph – 3 of the petition, though it is stated that petitioner has got criminal antecedent and he is accused in more cases, but it is clearly

stated that in all the cases, petitioner is on bail. Some of the similarly situated co-accused persons namely Abhishek Kumar Yadav, Arbind Kumar Yadav and Baiju Kumar Yadav have already been granted bail by this Court, vide order dated 28.10.2021 in Cr.Misc. No. 19198/2021, order dated 15.11.2021 in Cr.Misc. No. 22120/2021 and order dated 23.06.2021 in Cr.Misc. No. 9174/2021 respectively. In the present case, petitioner is in custody since 23.02.2020.

Learned A.P.P. for the State has opposed the bail

Considering the period of custody and the fact that similarly situated co-accused persons have already been granted bail, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Madhubani in connection with Rajnagar P.S. Case No. 58 of 2020, corresponding to C.R.I. Case No. 318 of 2020.
