The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code.

As per the prosecution case, a pickup van loaded with 45 batteries, a mobile phone of informant's cousin brother and Rs. 1,500/- were looted by five unknown miscreants on the gun point.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the

F.I.R. No T.I. Parade has been conducted. The name of the petitioner has come up in the confessional statement of coaccused Sanjay Yadav which has got no evidentiary value in the eye of law. The petitioner is an accused in one more criminal case as stated in para 3 of the bail petition. The petitioner is remanded in this case from Nasirgang P.S. Case No. 72 of 2021. The petitioner is in custody since 17.06.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that looted pickup van and other articles were recovered from the possession of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned below, Rohtas, in connection with Dinara P.S. Case No. 80 of 2021.
