Heard Mr. Sanjay Kumar @ S.K., learned counsel for the petitioner and Mr. Rana Randhir Singh, learned APP for the State via video conferencing.

Petitioner has renewed his prayer for bail inasmuch as earlier bail application of the petitioner was rejected by this Court on 06.07.2020 in Cr. Misc. No. 1319/2020 giving him liberty to renew his prayer for bail after six months if the trial does not show any substantial progress.

The offence as alleged against the petitioner relates to dowry death and the petitioner is the husband of the deceased.

Learned counsel for the petitioner submits that petitioner is in custody since 30.07.2019 and the trial has not progressed as yet and the situation, which was prevailing at the

time of rejection of the first bail application, still subsists inasmuch as, after framing of charge, no witness has yet been examined.

This Court vide its order dated 28.07.2021 had called for a report regarding stage of trial from the court of 13^th Additional Sessions Judge, Muzaffarpur and in pursuance thereof, the report has been received from the said court stating therein that the case is presently pending for examination of witnesses and altogether eight witnesses are there and none of the witness has been examined as yet by the trial court.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody for about 2 ½ years i.e., since 30.07.2019, the trial has not progressed as yet, none of the prosecution witness has been examined and this is the second attempt for bail on behalf of the petitioner, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, namely, CHINTU KUMAR SAHNI @ SENTU SAHNI @ CHINTU SAHNI @ SINTU SAHNI be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of 13^th Additional Sessions
