Heard learned counsel for the petitioner and the State

through video conferencing.

The petitioner seeks bail in Azamnagar P.S. Case No. 233 of 2021, registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, while the informant along with his brother returning from the Bank with cash of Rs. 1,80,000/-, on the way, four miscreants intercepted them and on the point of arms snatched the bag containing cash, laptop and Adhar Card etc. and during that course informant identified one of the miscreants as Sahbaz Ansari.

It is submitted on behalf of the petitioner that petitioner is neither named in the FIR nor any incriminating article has been recovered from his possession. Name of this

petitioner surfaced in this case during investigation on his own confession before the police. Petitioner has not been put on test identification parade till date. Petitioner is in custody since 27.09.2021 having no criminal antecedent.

Learned APP however, vehemently opposed the prayer for bail and submitted that cash of Rs. 6,000/- and Adhar Card of informant has been recovered from possession of this petitioner.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected.
