The petitioner is in judicial custody in connection with Sessions Trial No.138/2021 arising out of Chaori P.S. Case No.68/2018 instituted under Sections 307, 120B of the Indian Penal Code and Section 27 of the Arms Act.

Earlier the petitioner had moved before this Hon’ble Court for bail in Cr. Misc. No.55803/2019 which was rejected on 11.12.2019 by a co-ordinate Bench of this Court. The petitioner renewed his prayer for bail vide Cr. Misc. No.1418/2021 which too was rejected on 18.08.2021.

Nothing new has been brought on record for consideration of bail of the petitioner afresh and prayer for bail

is accordingly rejected.

Learned counsel for the petitioner submits that the petitioner is in jail since 09.05.2019 (as stated in para-12 of the bail application). He has further brought the attention of this Court to the order passed by the learned Sessions Judge rejecting his prayer for bail on 09.02.2022 in which it has been stated that the Trial has not commenced.

The Trial court is directed to expedite the Trial considering the fact that the matter is of 2018 and the petitioner is in custody since 09.05.2019. It is further directed that the Trial be concluded within a period of nine months, failing which a report be submitted on the ground/reason for its nonconclusion.

The bail application for the present stands rejected.
