Heard learned counsel for the petitioner and learned APP

for the State through video conferencing.

The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307 and 324 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner has antecedent of two cases and the informant alleges that on 04.06.2014 at 6.00 P.M. when informant was talking to other people near Anup Yadav’s house and her nephew was climbing the stairs of Anup Yadav’s house when from a corn field, seven accused persons including the petitioner arrived at the place of occurrence and thereafter, Muni Lal Yadav and Raj Kumar Yadav fired causing injury to the nephew of the informant on his right leg and left palm respectively.

The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest

that there is specific allegation of firing against Muni Lal Yadav and Raj Kumar Yadav. It is next submitted that in the case, police submitted charge-sheet only against Bablu Yadav as would be evident from Annexure-4 and against the petitioner, the investigation is still continuing. It is next submitted that since till now, nothing has come to connect the petitioner with the offence, as such, the investigation is continuing.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Barh P. S. Case No.204 of 2014, subject to the conditions laid down under Section 438(2) of the Cr.P.C. with a condition that one of the bailors of the petitioner shall be his brother-in-law namely, Shankar Kumar.
