Mr. Kumar seeks permission to withdraw the application with respect to petitioner no. 4 (Aditya Kumar @ Sikki), who has been arrested during the pendency of this petition.

The application with respect to petitioner no. 4 is dismissed as having become infructuous.

The petitioners no. 1, 2 and 3 seek bail in anticipation of their arrest in connection with Industrial Area P.S. Case No. 140 of 2020 dated 08.09.2020 instituted for the offences under Sections 341, 323, 406, 420, 504, 506 and 34 of the Indian Penal Code.

The accusation in the FIR is that despite the informant having paid money to one Vimla Devi for transfer of a plot of land to him, neither the land has been transferred nor the money has been returned.

The petitioners no. 1, 2 and 3 are sought to be prosecuted in this case on the charge of tacit approval of the illegal act of aforesaid Vimla Devi.

There is no accusation against the petitioners of

having accepted money or of having exhorted the informant to buy the property from aforesaid Vimla Devi.

Regard being had to the aforestated facts, the

court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 140 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
