Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing.

The petitioner apprehends his arrest in C2 A No. 199 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

92.250 litres of foreign liquor has been recovered from open place situated near the house of petitioner.

It is submitted that nothing has been recovered either from conscious possession or from house of this petitioner. Petitioner has got no concern with the seized liquor and he claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed in the event of his arrest/surrender before the court below

within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise IInd-cum-Additional District & Sessions Judge, Hajipur, Vaishali in connection with C2 A No. 199 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
