The petitioner seeks regular bail in connection with Punaura P.S. Case No. 15 of 2018 lodged under Sections 323, 324, 341, 379 and 307/34 of the Indian Penal Code read with Section 27 of the Arms Act.

The prosecution case is that in the evening of 02.12.2018 informant went to the chimney of one Ashok Kumar for payment. The said Ashok Kumar has refused to accept the payment, when he was returning back then three accused persons including the petitioner stopped him on way and then the petitioner fired gun shot upon the informant by which injury took place at the right leg of the informant, thereafter they

snatched Rs.30,000/- from the informant and fled away.

Learned counsel for the petitioner submits that charge sheet has already been filed in this case and he is in custody since 29.11.2021 having clean antecedent.

Learned counsel for the State opposes the prayer for bail and submits that it is a case of 2018 and four years is about to lapse but till date due to reluctant attitude of the petitioner, charge has not been framed.

In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail but only after framing of charge to the satisfaction of the Court below.

The petitioner shall appear before the Trial Court on each and every date and shall support the trial and in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond.

With this observations, the bail application is allowed.
