Heard learned counsel for the petitioners and

learned APP for the State.

The petitioners are apprehending their arrest in

a case registered for the offences punishable under

¶20

Sections 363, 120(B), 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the

F.IR named accused persons including petitioners have

¶23

kidnapped the daughter of the informant. The victim girl

¶24

has not been recovered as yet.

It is submitted by learned counsel for the petitioners that prior to lodging of the present F.I.R, petitioner No. 1 has filed Rupauli P.S. Case No. 09 of 2020 against the husband and son of the informant for allegedly killing his son. Moreover, as per F.I.R, the daughter of the informant was missing from 02.02.2020 but the F.I.R was registered on 13.02.2020 without explaining the delay. There is no independent witness to support the prosecution version and only on the basis of suspicion, this false case has been registered against the petitioners. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea
