2 13-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Nagar (Ratanpur O.P.) P.S. Case No. 126 of 2020 lodged under Sections 414/216/34 of the Indian Penal Code read with Section 25(1-b)a/26(2)/35/30 of Arms Act.

As per the allegation made in the F.I.R., the police party on secret information raid on the house of renowned criminal Ram Bharosi Singh, upon raid one Manu Kumar @ Munu Kumar was arrested and from his possession three live cartridges were recovered alongwith Android Mobile set.

Learned counsel for the petitioner submits that the present petitioner was not arrested from the spot and his name

has come in this case due to the reason that the accused Manu Kumar @ Munu Kumar visited to his house when he was not present. He further submits that the name of the present petitioner has been inserted by the police only due to suspicion. He further submits that petitioner is in custody since 22.06.2021 and charge sheet has already been filed in this case. On the point of criminal antecedent the learned counsel for the petitioner submits that there were in total 23 cases against the present petitioner about which he had categorically stated in paragraph no.3. He further submits that out of 23 cases, in 9 cases he has been acquitted and in rest of the cases except one he is on bail. Learned counsel for the petitioner further submits that so far as the merit of the present case is concerned no offence under Arms Act has been made out against the petitioner.

Learned counsel for the petitioner further submits that he is ready to appear before the trial court on day to day basis.

Learned counsel for the State opposes the prayer for bail and submits that the present petitioner is a renowned criminal and, therefore, case diary be called for.

After considering the facts and circumstances of this case that nothing has been recovered from the possession of the petitioner, petitioner was not even present to his house, let the

petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar, the learned Judicial Magistrate Ist Class, Begusarai in connection with Nagar (Ratanpur O.P.) P.S. Case No. 126 of 2020, subject to the condition that both sureties shall be his close relative.

The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.

Accordingly, the bail application stands allowed.
