2 03-12-2021 Heard the learned counsel for the petitioner.
Learned counsel for the petitioner has submitted that
vide order dated 5th March, 2005 in Probate Case No.105 of 2004, the probate case was decided in favour of the respondent, Sudhir Kumar Singh, the petitioner filed Revocation Case No.1 of 2005 to revoke the probate decree granted in favour of respondents vide order dated 5th March, 2005.
The main contention of the petitioner is that the Revocation case is pending for 16 years but still it has not been disposed of. He has also submitted that in Misc. Appeal No.196

of 2007 vide order dated 26th September, 2008, this Court directed the Court below to dispose of the interim injunction petition within a period of six months to the Court below. Learned counsel for the petitioner submits that as per direction of this Court that petition was disposed of and the status quo was granted, but after a lapse of 16 years, the case has not been concluded as yet.
In the above-mentioned facts and circumstances, the Court below is directed to take endeavour for expeditious disposal of the case, subject to priority list of his docket and any other legal or procedural impediment.
With these observations and directions, this Civil Misc. petition is being disposed of.
