Vide order dated 16.08.2019, the learned lower court has allowed the amendment petition and while allowing the petition, the learned Trial Court has mentioned in the impugned order that the sought amendment was of formal nature.
The learned counsel for the petitioners has submitted that the petition for amendment was filed at the belated stage and the case is going to be delayed.
I am not in agreement with the learned counsel. The amendment petition was allowed and by this civil miscellaneous application, the case before the learned court is going to be delayed. Under these circumstances, this civil miscellaneous application is dismissed with the direction to the learned lower court to expedite the matter.
This Court would expect that the petitioner’s Counsel would honour his undertaking in the instant proceedings regarding supply of requisite court fee etc. within two weeks from the date he is called upon to do so by the office.
