Heard learned counsel for the petitioner and learned counsel for the State.

The following reliefs as formulated by the petitioner have been claimed in the writ petition -

“(i) To direct the respondent authorities to make sufficient, adequate and satisfactory payment of compensation in the light of changes of types of village status by Six Men Committee with relates to N.H. 19 Chapra-Hajipur old road under the signature of authorities concern.

In view of the facts the land of petitioner has been acquired bearing Khata No. 1356, Khesara 832/3599 at Saidpur Dighwara and the land has been declared as N.H. Kinare through the Six Men Committee of C.O., D.C.L.R., S.D.O., Dy. Registrar and A.D.M. authorities but

compensation has not been paid accordingly due to malafide intention and oblique reason.

(ii) To provide compound interest on delay payment.

¶25

(iii) To impose heavy cost upon erring authorities and a departmental proceeding must be initiated with immediate step.

(iv) Any other relief/reliefs for which the petitioner is entitled for.”

At the outset itself, reference is invited to the petitioner’s representation dated 11.02.2019 (Annexure-5) before the District Land Acquisition Officer, Saran, Chapra which is said to be pending. It is submitted that it will suffice if a direction is given for disposal of such representation.

Having regard to the nature of the grievance and the stand of the petitioner, the writ petition is disposed of granting liberty to her to file a fresh representation before the District Collector-cum-Magistrate, Saran, Chapra (respondent no. 3) for redressal of her grievances. If any such representation is filed within a period of two weeks hereof, the same shall be considered and disposed of on its own merits in accordance with law and after grant of an opportunity of hearing to the petitioner expeditiously and in any event preferably within a further period of eight weeks thereafter.
