2 23-12-2021 The present petition has been filed for quashing the proceedings of the District Level Selection Committee, Jehanabad dated 21.03.2020 convened under the Chairmanship of the District Magistrate, Jehanabad whereby and whereunder the case of the petitioner for appointment on compassionate ground as a PDS dealer has been rejected.

Admittedly, the father of the petitioner, who was a PDS dealer, died on 31.12.2016 whereafter, the petitioner had applied for grant of PDS license on 02.02.2017. However, he was not

possessing the qualification of matriculation, hence his case was not considered and then the petitioner had again filed a fresh application in the month of April, 2019, after passing matric examination, however, the said application was filed beyond a period of two years from the death of the licensee, as per Rule 10 of the Bihar Targeted Public Distribution System (Control) Order, 2016, thus, the claim of the petitioner for appointment on compassionate ground has been rejected.

It would appropriate to reproduce the relevant portion of the decision taken by the District Magistrate-cum-Chairman, District Selection Committee, Jehanabad in its meeting held on 21.03.2020. The same reads as under:

We have asked the learned counsel for the petitioner regarding the position existing in law, to which learned counsel has not been able to give any reply whatsoever, inasmuch as the provisions contained in Bihar Targeted Public Distribution System (Control) Order, 2016, regarding grant of fair price shop license on compassionate ground, are unambiguous and against the petitioner.

Having regard to the facts and circumstances of the case and for the reasons mentioned hereinabove, we do not find any merit in the present writ application, accordingly, the same stands dismissed.
