Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is apprehending his arrest in connection with Jamui P.S. Case No. 662 of 2019 registered for offences under sections 419/420/224/353/385 of the Indian Penal Code.

In the present case, an allegation has been made that at the instance of the District Magistrate, Jamui, the S.D.O. and D.T.O., Jamui had gone to the office of Labor Superintendent for verification. When the D.T.O. asked about identification of the persons gathered, the petitioner caught hold at which the S.D.O. gave direction for lodging F.I.R. against the petitioner and he was arrested by the police. While he was on way to police station, he scuffled with the members and fled

away.

This Court has called for the case diary. From paragraph no.7 of the same, it appears that the petitioner was present at the place of working as a middle man for making availability of the license. It also appears that the petitioner was on way to the police station but, fled away by exerting the police force.

This Court is not inclined to grant privilege of anticipatory bail to the petitioner for the reason when he was arrested, he was to follow the law but, he jumped the car and fled away.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected for the present.

If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law preferably on the same day of his appearance.
