Heard Mr. Karandeep Kumar, learned counsel for the petitioner and Mr. Tarun Prasad Mandal, learned Additional Public Prosecutor for the State through video conferencing.

Petitioner renews his prayer for bail in connection with Chiraiya PS Case No. 506/2019 registered for the offence punishable under Sections 395 of the IPC inasmuch as earlier bail application of the petitioner was rejected vide order dated 19.10.2020 passed in Cr. Misc No. 23035/2020 (Annexure-1) with liberty to renew his prayer for bail after six months.

The allegation, as per First Information Report, is that when the informant was coming back after withdrawal of cash amounting to Rs. 1,89,000/- from the bank he was accosted by three people riding on a motorcycle and in the meanwhile, coaccused, Jitendra Patel and Dhiraj Gupta came on an Apache

motorcycle and Dhiraj Gupta pointed pistol on the informant. It has further been alleged that Jitendra Patel snatched bag containing cash from the informant. Thereafter, all the accused persons fled away.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and his name has transpired in this case on the basis of confessional statement made by Jitendra Patel who has been granted bail vide Cr. Misc No. 25276/2020. Learned counsel next submits that petitioner was not put on TIP and no looted money has been recovered from the possession of the petitioner and petitioner is in custody since 13.02.2020.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 13.02.2020, trial is not likely to be concluded in near future due to pandemic of COVID-19 and this is the second attempt of bail on behalf of petitioner, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, SATYAM KUMAR @ SATYAM CHAUDHARY @ SERJAN be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahana at
