Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks from the date of restoration of normalcy.

Heard learned counsel for the petitioner and learned A.P.P. for the State through Virtual mode.

The petitioner is apprehending her arrest in connection with Sonepur Hariharnath P.S. Case No. 78 of 2020 for the offence registered under Sections 406, 420, 467, 468 and 471 of the I.P.C.

The prosecution story, in brief, is that the informant,

namely, Rajiv Kumar Singh alongwith the petitioner started Centre of ‘Pradhan Mantri Kaushal Vikash Yojna’ in short (P.M.K.V.Y), at Sonepur Teachers Colony and the informant invested the amount for Class Room and the Lab Room. The petitioner assured that she will provide 70% amount to the informant. 911 women were provided training and examination was also conducted but no training certificates were provided to them and forged Aadhar Cards were prepared. When the informant visited the Centre then he noticed the aforesaid facts and he locked the room of Centre. It has also been alleged that he was provided with Rs. 19,00,000/- Lacs (Rupees Nineteen Lacs) Only and rest of the amount is due. On demand being made on phone, she abused him and also threatened him.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case due to local politics. There is no allegation of tampering with the witnesses alleged against the petitioner. The work of the scheme known as ‘P.M.K.V.Y’ was being carried out by the petitioner’s N.G.O. The informant is a private party who alleges that he entered into an agreement with the petitioner for carrying out the work of the scheme. It has further been alleged that 70% of the profit was to be given to the informant

and 30% was to be retained by the petitioner. There is no such document on record in respect of agreement entered between the parties. It has further been submitted on behalf of the petitioner that the petitioner could not have done so as the scheme itself did not provide subletting of the work of the scheme. There is no allegation that any public money is said to have been misappropriated by the petitioner. The petitioner is a lady and she is suffering from medical problems. She has been made accused in the present case for political reasons.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on her personal bond to the satisfaction of the learned Sessions JudgeIX, Saran at Chapra, in connection with Sonepur Hariharnath P. S. Case No. 78 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/-(Rupees Ten Thousand) only with two sureties of the like amount each within a period of

eight weeks to the satisfaction of the court concerned in connection with the aforesaid case.
