Heard Mr. Praveen Kumar Agrawal, the learned Advocate for the petitioner and Ms. Shaheen Begum, the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Khagaria (Chitragupta Nagar) P. S. Case No.257 of 2020, instituted for the offences under Sections 380 and 411 of the Indian Penal Code.

The learned Advocate for the petitioner has submitted that because of business dispute, he has been made accused in this case by falsely showing that many looted articles were recovered from a room which is said to be in his possession.

The learned Advocate for the petitioner has further submitted that the seizure list has been signed by a stranger viz

Maya Devi. He therefore submits that the seizure list cannot be relied upon.

Regard being had to the facts that a number of looted articles have been recovered from a room which is said to be in possession of the petitioner, I am not inclined to grant anticipatory bail to him.

The prayer for anticipatory bail is rejected.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below shall take into account all the grounds afore-noted and shall pass orders in accordance with law, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
