Heard learned counsel for the petitioner. No one appears on behalf of the State, although the name of Advocate General appears in the cause list.

Allegation against the petitioner is that he was involved in the process of solemnizing marriage with a minor girl, aged about 14 years.

The petitioner is in custody in connection with Dighalbank P.S. Case No. 09 of 2019 for the offence under Sections 9, 10, 11(1) of the Child Marriage Act, 2006.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 27.02.2019. He further submits that Fua of the victim girl, who was also involved in solemnizing the alleged marriage, has

been granted bail vide order dated 26.06.2019 in Cr. Misc. No. 38998 of 2019.

Considering the fact that Fua of the victim girl has been granted bail and also the fact that the petitioner is in custody since 27.02.2019, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Kishanganj in connection with Dighalbank P.S. Case No. 09 of 2019.
