The petitioner seeks bail in Begusarai Muffasil P.S. Case No. 482 of 2016, registered for the offence punishable under Sections 302, 379 and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, all the accused persons named in the FIR came on motorcycle and started abusing the informant and upon exhortation co-accused Mannu Singh fired upon the head of Kamalkant @ Bijli (brother of informant) and also opened indiscrimate firing, as a result of which Sanjeev sustained injury. Thereafter, Manu Singh entered in godown and took Rs. 48300/-. On the way to hospital Kamalkant @ Bijli died.

It is submitted on behalf of the petitioner that

petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Akhilesh Kumar @ Akhilesh Sharma who has been granted bail by this Court. Specific allegation of firing is against co-accused Manu Singh. Petitioner claims clean antecedent and he is in custody since 21.01.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 482 of 2016.
