Heard learned counsel for the petitioner and the State.

The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, FIR named accused persons and other unknown miscreants surrounded the brother of the informant and made indiscriminate firing causing his death. It is further alleged that the petitioner in league with other coaccused persons conspired and get his brother killed.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is only alleged to be conspirator and he was not present at the place of occurrence as at the time of occurrence

he was in judicial custody in connection with S.Kamal Police Station Case No. 208/20. It is further submitted that the assailant of informant’s brother are named in the FIR. Petitioner is in custody since 9.11.2020. Similarly situated coaccused Dilip Yadav has already been allowed bail by a coordinate bench of this Court vide order passed in Cr.Misc.No. 14233/2021.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Balia Police Station Case No. 242 of 2020.
