Heard learned counsel for the petitioner and learned APP for the State.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 307, 323, 324, 325, 341, 354(A), 447, 504, 506 of the Indian Penal Code.
Prosecution case as alleged in the FIR is that on 14.05.2019 the informant Sunita Devi was sitting on her door in the meantime Vikas Kuma with sword in hand, Dinesh Ray with farsa in hand and other accused persons including 10 others unknown, all residents of village- Raghunathpur tried to carry over the ‘NAD’ when she forbade then, Umesh Ray abused her and order to beat her causing injury in her arm and back. Shiv Nath Ray came to rescue her, they assaulted on his head by Talwar and broken his left leg and left arm by assaulting by lathi and rod. When Bishun Ray came to rescue, Dinesh Ray gave a farsa blow on his head. Meanwhile, they broken the right hand of Mithilesh Ray. When her daughter Pratima Kumari came to rescue Mahesh Ray put his teeth on her breast and they broken her right arm.
Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence as alleged, but has falsely been implicated in this case due to dirty village politics. There is no specific overt act has been alleged against the petitioner and there is general and omnibus allegation. There is occurrence took place on 14.05.2019 and the FIR was lodged on 17.05.2019 and it was sent to the court on 20.05.2019. The petitioner has got no criminal antecedent.
In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Samastipur, in
