Heard learned counsel for the petitioner and

learned counsel for the State via video conferencing.

By way of the present application, the petitioner

has sought for bail in connection with Rajnagar P.S. Case No.102 of 2019 registered for the offence punishable under Sections 323, 341 and 364 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner’s father had purchased a piece of land from the land holder namely, Babu Sri Shrutidhari Singh on 09.05.2017 vide registered sale deed bearing Khata No.524, 529 and 532 measuring 12 dhoors. The said land was mutated in favour of the petitioner’s father. The petitioner asked the husband of the informant to vacate the said land and he took three months time to vacate the plot, but even after expiry of

three months when the informant did not vacate the land and sought further time, a panchayati was called for and finally three months time was further extended. The husband of the informant gave an undertaking through an affidavit dated 27.03.2019 to vacate the land within 90 days. After the said affidavit, husband of the informant returned back to his home and under a conspiracy, the informant lodged a frivolous case of kidnapping on 28.03.2019. He contended that as a matter of fact the husband of the informant was never kidnapped, which would be evident from the affidavit dated 27.03.2019 itself.

Learned counsel for the State has opposed the application for grant of bail to the petitioner.

Regard being had to the facts and circumstances of the case and the submissions made above, the petitioner, who is in custody since 27.11.2019, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Madhubani in connection with Rajnagar P.S. Case No.102 of 2019.
