2 14-10-2020 Heard Mr. Ajit Kumar, learned counsel for the petitioner and Mr. Nirmal Kumar Sinha, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Excise Case No. 177 of 2020 arising out of Barbigha P.S. Case No. 150 of 2020 registered for the offences punishable under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioner is that the Police raided the house of the petitioner and recovered 06 litres of illicit country made liquor and some utensils for manufacturing liquor.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged

inasmuch as the illicit liquor has been recovered from a room made of asbestos ( karket ) situated on the roof of the house of the petitioner which is a joint family property and other cosharers also reside in the same. Learned counsel further submits that the petitioner has got no criminal antecedent and he is in custody since 17.06.2020.

Having heard learned counsel for the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent and he is in custody since 17.06.2020, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Sheikhpura, in connection with Excise Case No. 177 of 2020 arising out of Barbigha P.S. Case No. 150 of 2020.

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
