Heard Mr. Kumar Kamal Nayan, learned counsel for

the petitioner and Mr. Nawal Kishore Prasad, Additional Public Prosecutor for the state through video conferencing.

Petitioner seeks regular bail in connection with Kasim Bazar PS Case No. 232/2019 registered for the offence punishable under Section 394 of the IPC and later on under Sections 395, 397 and 412, charge-sheet was submitted.

The allegation, as per First Information Report, is that three to four persons have entered into the house of brother of the informant, stolen the household articles and injured the brother and sister-in-law of the informant.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and the petitioner has been remanded in this case on the basis of

confessional statement made in Kasim Bazar PS Case No. 234 of 2019. Learned counsel submits that on the confessional statement of the petitioner, allegedly, a sum of Rs. 15,000/- was recovered from his house. Learned counsel for the petitioner further submits that on the basis of his confessional statement, other accused persons, 7 to 8 in numbers, have been arrested in the present case out of which three persons have been granted bail by this Court on similar allegation in Cr. Misc. Nos. 1163/2020, 12868/2020 and 19053/2020.

Learned counsel further submits that TIP was conducted by the police but the victim has not identified the accused persons. Learned counsel next submits that petitioner is in custody since 17.10.2019.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated accused persons have been granted bail by this Court and the petitioner is in custody since 17.10.2019 , I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, CHHOTU KUMAR @ CHHOTU SINGH @ ANANT KUMAR be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of
