Heard learned counsel for the parties.
The petitioner apprehends his arrest in Special Case No. 10304 of 2019 arising out of Nadi P.S. Case No. 285 of 2019 registered for the offence(s) punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, during petrolling, when police reached near Apna Hotel, one person started running away from the police and managed to escape. On search, there was a recovery of 12 litres of Mahua wine from the hotel and the nearby persons disclosed that the person who had managed to escape was the petitioner.
In view of the fact that there is a recovery of 12 liters of wine from the hotel of the petitioner, I am not inclined to grant
