The petitioner is in custody in connection with Muffasil (Aurangabad) P.S. Case No. 15 of 2020 for the offenses under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

In the instant case 198.72 liters of liquor was seized.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 30.01.2020. Nothing was recovered from the conscious possession or from the house of the petitioner.

Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for more than seven months, the Court is inclined to grant bail to the petitioner

subject to deposit of Rs. 50,000/- cash.

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cum-Special Judge (Excise Act), Aurangabad in connection with Mufassil (Aurangabad) P.S, Case No. 15 of 2020 subject to deposit of Rs. 50,000/- (Fifty Thousand) cash.

The deposit of cash of Rs. 50,000/- (Fifty Thousand) shall abide by the final outcome of the pending criminal case.
