Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Sahebganj P.S. Case No. 544 of 2019, registered for the offence punishable under Section 394/304 of the Indian Penal Code.

As per prosecution case, on 14.12.2019 at about 2.00 p.m. while the informant was taking her husband to Muzaffarpur for medical treatment and waiting for tempo, in the meantime, petitioner came and advised her to get her husband treated at his clinic. Thereafter, informant took her husband to the clinic of

petitioner, where, the petitioner gave some injections to the informant’s husband. On 15.12.2019, the husband of informant died. It is further alleged that petitioner and other staffs fled away from the clinic.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Entire allegation is false and concocted. Petitioner has never treated the husband of informant. Petitioner is in custody since 21.01.2020 having clean antecedent.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, West Muzaffarpur in connection with Sahebganj P.S. Case No. 544 of 2019, subject to following conditions:-

(i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below.

(ii) If the petitioner tampers with the evidence or the
