Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 149, 307, 323, 379 and 504 of the Indian Penal Code.

Prosecution case in short is that informant of this case has given a written application before the Officer-in-Charge of the concerned P.S. on 04.10.2019 when the informant was going to market then Yugal Mishra stopped the way and spoken do not got through here, on this accused persons started abusing and assaulted from iron blow on the head of the informant, on hulla Anil Mishra reached then son of Yugal Mishra and petitioner namely Murari Mishra again attacked with iron rod to kill and Nityanand Mishra also started to assault with lathi danda on his family. It is further alleged that accused persons have assaulted with rod upon Devesh Kumar Mishra from which he became

unconscious. From his neck also snatched golden chain, on hulla some persons came there and taken away hospital for treatment of injured persons.

Learned counsel for the petitioner submits that there is no specific allegation and there is general and omnibus allegation against the petitioner. There is case and counter case. In the injury report all the injuries are simple in nature. The petitioner has got no criminal antecedent.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sheohar, in connection with Purnahiya P.S. Case No. 95 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
