for the petitioner, Mr. Dharmendra Kumar Paswan, learned counsel for the informant and Mr. Narendra Kumar Singh, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner apprehends his arrest in connection with Makhdumpur P.S. Case No. 511 of 2019 registered for the offence punishable under Section 448, 341, 342, 354, 354(B) of the I.P.C.

The allegation against the petitioner as per the First Information Report is that petitioner entered into the house of the informant on 29.10.2019 at about 12.00 O’ Clock in night and tried to outrage her modesty.

Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to land dispute between the parties. Learned counsel further submits that informant is the cousin sister of the petitioner.

On the other hand, learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that petitioner is a habitual offender and he is in the habit of committing such kind of offence and there is no relationship between the petitioner and the informant and they are only co -villagers.

Having heard learned counsel for the parties and taking into consideration the statement made in paragraph no. 7 of this anticipatory bail petition that the informant is the cousin sister of the petitioner and the petitioner has got no criminal antecedent, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, in the event of arrest or surrender before the court below within six weeks from today, petitioner, above named, shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jehanabad in

connection with Makhdumpur P.S. Case No. 511 of 2019, subject to the condition as laid down under Section 438 (2) of the Code Of Criminal Procedure.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
