The grievance of the petitioner in the present writ petition is non-consideration of his case for grant of ACP.

The scheme of ACP/MACP was coined to do away stagnation. The petitioner was appointed in 1971 and he was granted first time bound promotion. The benefit of time bound promotion was available up-to 31^st of December, 1995. It ceases to exist from 1.1.1996. Thereafter, the respondents introduced ACP/MACP scheme for grant of senior scale. The Scheme of ACP/MACP is financial up-gradation on account of nonavailability of promotional avenues.

Since the petitioner was appointed in 1971, the respondents are required to examine the claim of the petitioner for grant of second time bound promotion, if the petitioner was eligible up-to 31^st of December, 1995 or consider the case of the petitioner for grant of ACP under the ACP/MACP Rules strictly in accordance with the scheme of ACP/MACP. Necessary decision with all consequential benefits must be taken by the respondents at the earliest preferably within a period of three months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
