The petitioner in Public Interest Litigation raises the cause of rhinos as according to the petitioner, the rhinos are available in the Valmiki Tiger Reserve and as per the complaint of the petitioner, these rhinos are being captured for export to Nepal.

It is on the direction of this Court that a counter affidavit is filed and which does admit of a cross over by one-horned rhinos

from Nepal or neighboring country but denies any such allegation of illegal export.

The situation is explained in paragraph 7 of the counter affidavit which while admitting the presence of tiger, leopard, sloth bear, wild dog, striped hyena, sambar, nilghai, Indian gaur, chital, hog deer, barking deer, wild boar, gharial, fresh water crocodile, gangetic dolphin, king cobra etc., informs that elephant and onehorned rhinos from Chitwan and Parsa National Park in Nepal on the northern and eastern boundary of the State do across over to the Valmiki Tiger Reserve occasionally but return to their original habitat.

In such view of the matter, we are not persuaded to keep this writ petition pending, which is accordingly disposed of.
