7 23-01-2019 Heard learned Counsel for the petitioners and the learned Counsel for the respondent State.

By filing supplementary affidavit Mr. Jha has pointed out that typographical error has crept in the description of petitioner Nos. 56, 64 and 89 of the writ petition.

With regard to petitioner No. 56, it is submitted that in stead of Email Kumari the name should be corrected as

Regarding petitioner No. 64 it is pointed out that in stead of Bhala Manjhi the same may be read as Bhola Manjhi as the correct name of petitioner is Bhola Manjhi.

In respect of petitioner No. 89 it is submitted that description of the centre has been wrongly typed along with the correct name of the centre Balarpur but due to inadvertance “and Saharna” was added in the description which is not part of the name of the centre in question.

In view of such error in description of the center with regard to petitioner No. 89 the details be corrected and from the same “and Saharna” be deleted.

The said typographical errors are therefore directed to be rectified, accordingly.

It is submitted by Counsel for the petitioners that the claim of the petitioners is squarely covered by the decision in the case of other similar situated in CWJC No. 384 of 2017 which has been affirmed by Division Bench in LPA No. 1047 of 2017.

In view of such submission the writ petition is disposed of. The respondent authorities should consider the claim of the petitioners and if found to be similarly situated and

covered by the judgment in the case of State of Bihar & others vs. Harendra Mishra & ors in LPA No. 1047 of 2017 same benefits be extended to the petitioners.

It is submitted by Counsel for the petitioners that in respect of IA No. 9871 of 2016 he may be permitted to raise the grievance of the petitioners therein in appropriate proceeding.

The said prayer of the petitioners is allowed. The I.A. is therefore dismissed as not pressed with liberty as prayed for by the petitioners.
