Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends her arrest in connection with Derni P.S. Case No. 132 of 2018 for the offence punishable under Section 304(B)/34 of the Indian Penal Code and Section ¾ of Dowry Prohibition Act.

The allegation is regarding the accused persons having killed the victim deceased lady on account of nonfulfillment of demand for dowry.

The learned counsel for the petitioner submits that the petitioner is the mother-in-law of the deceased victim lady and the father-in-law has already been granted bail by a coordinate Bench of this Court. It is further submitted that the husband is languishing in custody and no prejudice would be

caused to the prosecution in case the petitioner is granted bail. The petitioner is stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner above named is directed to be released on anticipatory bail on furnishing bailbonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM VII, Saran at Chapra in connection with Derni P.S. Case No. 132 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
