The petitioner has been in custody since 05.10.2018 in connection with Lakhisarai P.S. Case No. 616 of 2018 registered for the offense punishable under Sections 272/273 of the Indian Penal Code and Section 30(a), 32(2) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that though the alleged recoveries are of 181 liters of country-made liquor kept in 12 plastic jars hidden underground, the case of the petitioner is that the said recovery does not belong to the petitioner. It is further submitted that the same have not been recovered from his conscious possession, the petitioner may be extended the privilege of regular bail.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge cum Special Judge (Excise), Lakhisarai, in connection with Lakhisarai P.S. Case No. 616 of 2018.
